This page sets out mystrix's business classification under Indian law for payment partners, banks, and regulators. It supplements our Terms of Use.

1. Business Classification

mystrix is a gamified e-commerce (retail) business. We purchase, stock, and sell real physical products. The "gamified" element is a presentation layer on top of an ordinary retail transaction — comparable to a blind-box, lucky-dip, or surprise-bag retail format that is widely sold by mainstream e-commerce platforms.

For payment-aggregator and acquiring-bank classification purposes, mystrix should be categorised under general merchandise / online retail (e.g. MCC 5310 / 5399), not under betting, lottery, or online-gaming codes (e.g. MCC 7800 / 7995). The substance of every transaction is the sale of goods at a fixed, advertised price — not a wager on an uncertain monetary outcome.

2. The Legal Test for "Gambling" Under Indian Law

Under the Public Gambling Act, 1867 and the corresponding state enactments that most Indian states have adopted, "gaming" / "gambling" centres on a wager or stake — money risked on an uncertain event where the participant may receive nothing of value in return if the event does not go their way. This is the same principle the Supreme Court applied in State of Bombay v. R.M.D. Chamarbaugwala (1957) and later cases on fantasy sports and online games: a transaction is not gambling merely because an element of chance determines what a paying customer receives, so long as the customer is guaranteed to receive something of commensurate commercial value in every outcome.

Applying this test to mystrix:

  • Every contest entry is charged at a fixed, pre-disclosed price.
  • Every entry results in the delivery of real, physical product(s) with a value at or above the price paid.
  • There is no outcome in which a paying customer receives nothing, a refund of "credits", or cash winnings.
  • The random element (the wheel spin) determines product allocation only — never whether the customer is paid out.
  • No customer can lose their stake. The closest legal analogue is a retail "mystery bag" or "blind box", not a lottery ticket or bet.

Because no stake can be lost and no cash prize is ever paid out, mystrix does not meet the statutory definition of "gaming", "betting", or "wagering" under the Public Gambling Act, 1867, the Prize Competitions Act, 1955, or applicable state gaming enactments.

4. E-Commerce & Consumer Protection Compliance

mystrix operates as an inventory-led e-commerce entity and aligns its practices with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Rules, 2021, including:

  • Clear, pre-disclosed pricing for every contest entry before payment.
  • A published Terms of Use describing exactly what a customer receives.
  • A published Privacy Policy describing data handling.
  • A grievance / support channel for order, delivery, and refund issues.
  • Defective or incorrect product replacement procedures.
  • All payments processed through a licensed payment aggregator — no peer-to-peer cash transfers, credit lines, or stored-value "winnings" ledgers.

If your compliance or risk team is reviewing mystrix in connection with a payment aggregator, payment gateway, or banking relationship, we are happy to provide:

  • Sample order records showing product allocation and delivery for completed contest entries.
  • Inventory and sourcing documentation for products offered.
  • A walkthrough of the contest flow demonstrating that every entry results in product delivery, never a cash payout.
  • Confirmation of the recommended merchant category classification (general retail / online merchandise).
